The basic document of Nail-art.info – the order of interaction between authors and the owners of the site. Version 5.0 from the 13th of June 2004. This offer regulates the relations between the Author and the Customer concerning objects of author's rights. 1. Parties’ denomination. 1.1. An Author is a person, possessing author’s rights for the work. 1.2. The Customer is Bukin D.S., who represents the owners of the site Nogti.com and implements acquiring of rights for the works, produced by the Author at the address concurs@nail-art.info. 1.3. Site is an electronic system of the Customer; it is situated at address Nail-art.info and its official “branches”. 1.4. A work is a unique image of women’s manicure and its description. 1.5. Transfer of the work is accepting of the offer, given below, by the Aythor and transmission of a work through the professional profile in the category “Authors” at www.nail-art.info. 2. Subjects of the offer. 2.1. The Customer conducts the regular international competition for the best work of nail-art (women’s manicure) in the Internet with a view to stimulate and support creative abilities of the modern informational society. 2.2. The rules of the competition are given here. 2.3. The works, sent for the competition in accordance with established procedures, are placed on the Customer’s site and translated into the English language. 2.4. The Author transfers and the Customer receives the works in accordance with procedures, established in this offer. 2.5. The Customer pays the Author a fee in case if the Work meets the requirements, prescribed in the offer, and is worth publication in the electronic or printed issues of Nail-art.info. 2.6. The Author automatically hands the interests over to the Customer after the payment was completed. 2.7. The Author unrestrictedly holds the rights for the Work until the Customer acquires them. 2.8. The order and terms of the payments for the works, transferred by the Author, are defined by the Customer. 3. Basic regulations. 3.1. If the works, coming from the Author to the Customer to the address info@nail-art.info, meets the requirements of the clause 5, they are paid by the Customer in two ways: 3.1.1. as 2$ per 1 work at the moment of including these Works in the list of materials, which are of interest for publication in the electronic or printed issues of Nail-art.info, as well as for other intentions of the Customer. 3.1.2. in case of including the Work into the MMS (Multimedia Message Service) mailing list for the cellular network subscribers on the territory of Russian Federation – 0.01$ (1 cent) for each loading of the picture. 3.2. The Customer determines the time for publication of the Works, arrived at the address www.nail-art.info., independently. 3.3. Customer determines the time for acquisition of rights for the received Works independently. 3.3.1. The payment should be accomplished each quarter in accordance with clause 3.1.2. within 20 days from the date of the payments to Nigti.com, accomplished by the representative organizations and partners, implementing the payments with the capcoms. 3.4. Customer doesn’t take up the Works that are out of the requirement limits of the clause 5. 3.5. As soon as the Customer transfers payment for a work on the Author’s account, the Author hands the interests for that work over to the Customer for entire period of validity of author's rights, not less than 25 years, on the territory of Russia and countries of the world community. The Customer can use the works unrestrictedly. The Author can use these works with the written permission of the Customer. 3.5.1. The payments accomplished in accordance with the clause 3.1.2. continues until the end of actual using of the Work in the MMS mailing list. Besides, the rights for the Work are transferred to the Customer after the payment to the Author (2$) has been accomplished. 3.6. The contract between the Customer and the Author, confirming the situation of the clause 3.5., is signed if the Customer acquires at least 10 works of the Author. The absence of such contract doesn’t abolish Customer’s interests for the works, paid by the Customer in accordance with the clause 3.1. of this Offer. 3.7. The transmission of the works to the address info@nail-art.info implies the Author’s consent with conditions, cited above, and reception of the liabilities for its accomplishing. 3.8. All the works, published in accordance with the clauses 3.1., 3.2. of this Offer, take part in the present international competition Nail-art.info. Prize payments are conducted according to the rules of this competition. The size of the prize is established according to the size of prize fund of the competition. 4. The order of payment. 4.1. Payment for the Author’s works is conducted by the Customer through the system Webmoney Transfer on the account WMZ. 4.1.2. The Customer should inform the Author about the terms and dates of payments not later than 3 three days before the payment should be accomplished. 4.1.3. The Author must supply all the properties for the way of payment chosen by the Author. 5. Requirements for works. 5.1. The Works should be entered on Nail-art.info singly through the professional profile in the category “Authors”. 5.2. Any work should include two graphic files of nail-art (format JPG, the first picture – general view, not lager than 800x600pic, size – less than 150 kb; the second picture – the nearest approach to the nail, no more than 150x150pic, size – less than 50 kb) and description (total runtime, order of operations, necessary materials and instruments). 5.2.1. Description of the nail should correspond with the variant represented in the personal profile. 5.2.2. Digital picture should be done by putting the hand on the scanner not by using a camera. Don’t press hands to the glass (otherwise a picture can be spoiled by white spots of pressed parts of the skin), you can hold the scanned hand by the other one or lean on the nails. The more professionally the picture is made, as well as the pattern on the nails, the more chances for victory you have. Don’t insert background pictures. Don’t elaborate the picture – send the original (professional editors can only do it). 5.3. The Author should mention the following items, handing the work over: - the name of the work and the Author’s full name or a nickname in the field Subject, for example: “The name of the work, full name/nickname”; - the category, into which the work is transferred – Amateurs or Professionals; - Essential Elements of the account in the system Webmoney – WMID# and WMZ#; - his/her e-mail. 5.4. The fact of including of the Work is its successful loading through the personal profile. 5.5. The fact of publishing of the Work is its allocation in the next renewal of Nail-art.info. 5.6. If the Work doesn’t meet the requirements of the clause 4 or contains any shortcomings the censors of Nail-art.info reserve the right to reject publication of the Work until all the drawbacks are eliminated. 5.6.1. The censors of Nail-art.info are entitled to deprive the Author to publish his/her Work if the Work obviously lacks its artistic value and individuality within Nail-art.info. This decision is made by the censors singly.
